The legal context
CBD has been legally accepted and recognized for several years in many states across the Atlantic. Over there, the use of therapeutic cannabis is widespread. In the EU, and therefore in France, it's a different story... But faced with a market that's only too happy to flourish, the old continent could no longer turn a deaf ear.
Last year (2020), the United Nations Commission on Narcotic Drugs announced the removal of cannabis from Schedule IV of the 1961 Single Convention on Narcotic Drugs. This was a major step forward for the therapeutic cannabis industry. Until then, the plant had been listed alongside such toxic substances as heroin...
On that occasion, it was made clear that CBD, as a non-psychotropic cannabinoid, has never been and is not considered a narcotic. It can therefore circulate freely internationally. In practice, however, the circulation of CBD and CBD-based products in France remained unclear ...
In November, the Kanavape ruling (producer of CBD e-liquid) clarified the situation. The Court of Justice of the European Union ruled unequivocally: CBD is not a narcotic, and as such, there is no reason to prohibit or hinder its circulation.
CBD authorized in cosmetics: why is this a breakthrough for the entire industry?
CBD is legal: it can be sold and consumed without any problem. However, until now, it has not been recognized as having any beneficial properties.
In fact, despite numerous scientific studies, it is strictly forbidden to claim that CBD has relaxing properties. Or that it helps maintain neurological health, is an excellent painkiller, and so on.
Until now, producers and sellers of creams and beauty products formulated with CBD were unable to communicate the benefits of the molecule on the epidermis... Of course, informed consumers could find information on the Internet. But the lack of claims was a thorn in the side of anyone wishing to promote their product.
Today it's official: CBD can legally be claimed to be anti-sebum, antioxidant, moisturizing and protective. Who knows, maybe tomorrow we'll be able to claim that it's also a natural anti-stress agent, a powerful analgesic and that it can prevent the cellular degeneration that causes cancer...
